In conjunction with three.co.uk and a company called Free Upgrades ltd (po box 186 leeds) freeupgrades.co.uk

Friday, 27 March 2009

Dear Sir/Madam
With regard to telephone calls today I enclose for return the handset you sent me and ask that you kindly cancel the contract set up by yourselves.
The conversation I had on the telephone about taking a new contract with yourselves stated I would not be charged any fees for leaving t-mobile and switching to your service, I was told by your company that my contract with t-mobile ends this month so I will not be charged anything and can change over with immediate effect, I therefore returned the requested form to you to change my number over to your service. I was told that the monthly fee will be £28.00 per month and no more. I still have not had the number transferred to you but have been charge for a month line rental as you supplied a temporary number and set up the contract. I have today printed the line rental bill too which I was charged £28.30, not much over but it is over what it was contracted to be. I also received my invoice from t-mobile which a fee has been added for early termination which you told me I would not get charged. I have today also been told by t-mobile that my actual contract expires not in march like I was told by you but in April. You agreed on the phone you would pay this fee but cannot discuss the line rental charges, because of these problems and my unhappy situations regarding this matter, I write to ask that you cancel the contract and let me know in writing of your decision,

Regards
Barry

letter from free upgrades:

Dear Mr Wade

i am sorry you wish to cancel your agreement with the 3 netwok. i have received your handset back however on reviewing notes on your account i have noticed you have returned the handset outside of your cancellation period. you have a period of 7 days, starting the day after you receive the goods to either provide written intent to cancel or return the handset. unfortunately we have received your samsung l770 platinum silver limited edition outside of this time period and have no record of any letter being received within the time period, on this basis i would not be able to cancel your contract as requested.

i would therefore like to return your samsung l770 platinum silver limited edition back to you at your convenience to allow to continue using the networks services, if you could please call our customer care team on 0800 288 8858 to arrange redelivery we can have your handset back to you in 2 working days, our lines are open 9am-6pm mon - fri abd calls are free from a landline, due to limited storage space we can only hold on to your handset for a period of 120 days, if your handset remains uncollected after this time we may have to dispose of the handset

if you require any further information please ring our customer care team on 0800 288 8858

i stated to them the phone was second hand and they said they discussed it could be, although i dont remember that at all, free upgrades told me my number would transfer over as that is what i wanted within a few days, 2 weeks later still no changeover, how do i return within 7 days as its not my fault, they reckon they never received the pac code i sent on their pre-printed for and pre-stamped envelope so this was never actioned.

i was told by free upgrades that i would not be charged a penny over £28, i have a bill that was paid at £28.30

t-mobile were going to charge roughly £40 for the transfer but i stayed with them for now because of all this

Advisor Zalman has entered the session.
barry wade: Amend my details - hi
i contact three today and got put on hold listening to music in the end i hung up, i was misled into taking out a three contract and mobile
phone and shortly after poor and lack of service was received so i tried to cancel the contract straight away, three told me i need to speak to
the people who provided the phone and those people said i need to speak to three so i ended up going in circles, i returned the phone along
with a letter of cancellation and also told three i will not be paying any bills, three then last month took money from my bank account of which i
have now stopped, the account number is 9366257088, i urgently ask you to close this account and make any balances £0 and reply via email
or post to that effect, i will be visiting my local Citizens Advice Bureau also for harassment aswell as being sold a misled contract if i receive
any further requests for payment
regards
Barry
Advisor Zalman: Hi Barry, this is Zalman at 3.
barry wade: i have also emailed this via the form on the website. my email address is barry@ezhost.co.uk if any replies can be sent
Advisor Zalman: I'm just reading the information you've provided. This is going to take a few minutes, please bear with me.
barry wade: ok thank you
Advisor Zalman: You're welcome.
Advisor Zalman: Can you please confirm your name, postcode and date of birth?
barry wade: barry wade, en9 1sr, 30/11/1969
Advisor Zalman: Thanks Barry.
barry wade: the initial request was by phone around 23rd march then i put in in writing on Friday, 27 March 2009
Advisor Zalman: One moment please...
Advisor Zalman: I understand you intend to cancel the contract, however since you've taken the contract from a retail store you'll need to contact them for the cancellation of the contract within the 14 day period.
Advisor Zalman: Can you please confirm the reason why you want to cancel the contract?
barry wade: exactly my point as before i go round in circles with three asking me for payments
barry wade: sure here is the letter i sent on 27th march : Dear Sir/Madam
With regard to telephone calls today I enclose for return the handset you sent me and ask that you kindly cancel the contract set up by yourselves.

Advisor Zalman: The bills are generated on the account as the contract is not cancelled.
barry wade: the bills will keep generating if three do not cancel the contract
barry wade: and since the contract was mis-sold i believe i am not liable
Advisor Zalman: I'm reading the information, please wait.
barry wade: ok

continued.....

Advisor Zalman: Thanks Barry.
Advisor Zalman: You are on a contract for £28.00 per month as line rentals and on the first bill you're charged £28.30 wherein the extra charge is the line rentals for 1 day when the phone was activated and the bill was generated on the next day.
Advisor Zalman: You're charged the line rentals in advance on a contract account as the free allowance for the month is given to you as on the bill date which is on the 8th of each month.
barry wade: my phone number wasnt even transferred as agreed so i also dont intend paying for a temporary number i didnt want in the first place
barry wade: £28 or so for a temporary number why would i want that?
Advisor Zalman: I understand your concern, however we cannot transfer your old number over to 3 unless the account is not activated and you need to get the PAC code from your old service provider.
barry wade: that was done within a couple of days of the contract being set up and nothing was transferred
Advisor Zalman: There is no request on the account to transfer your number to 3 and according to your phone call on 27th March 09, we had requested you to get the PAC code so that we could get this done for you.
barry wade: no request to transfer it, that was the reason i partially agreed to the contract
Advisor Zalman: Its only if you have the PAC code you can get the number transferred to 3 and the old service provider would only provide the code to you as this means you're canceling your account with them.
Advisor Zalman: I understand you wanted to transfer the number, this can only be done once you provide us the PAC code from the old service provider.
barry wade: so no request on the account means the conversation to set up the contract doesnt exist either
Advisor Zalman: The contract with 3 is still active with the mobile number provided by 3 along with the contract.
Advisor Zalman: If you want the number to be transferred you'll need to provide the PAC code.
barry wade: obviously this contact is going to be cancelled and a zero balance provided for all the terms of being mis-sold and mis-led a contract that wasnt as stated at the beginning?
Advisor Zalman: One moment please...
Advisor Zalman: I'm sorry you feel this way, however there seems to be no mis-sold or mis-led contract as you're on the £28.00 deal and the number was not transferred over we haven't received a PAC code.

what a surprise i got cut off from their window and another surpise - i took out the contract to take my number with me, their advisor says as above: Advisor Zalman: There is no request on the account to transfer your number to 3

today i received a call from three's debt collection agency saying a letter is in the post, updates to follow
CommentAuthoradmin CommentTimeMay 14th 2009 edit delete Report Post
the contract was dated 10th march 2009 and i returned on 27th march because the return policy is 21 days, which i dont think should be allowed because i wasnt even switched over to their service, it should be 21 days from when my number is active, instead they are charging me and still trying to charge me for a temporary number they set up

i telephoned Advanced Telecoms Debt Collection Services Ltd just now, instead of them asking 'what is your enquiry' straight away the guy said 'how do you wish to pay', i said i dont intend to pay as i was missold the contract, he said i need to go back to free upgrages 'i think he used the term mistral too' to speak to them about the contract, i told him they refused to help and he said i should try again, then he said i cant help you any further and hung up as i disagreed with him that freeupgrades would do anything about the situation, i am going to phone freeupgrades once more in a few moments and will post the outcome here

I have had a contract with Three for mobile internet which was in my opinion miss sold. I have never been able to get a satisfactory service and tried to end the contract in February 2013. I contacted them by phone, internet, and post, but they do not listen, they do don't acknowledge correspondence. I got the harassing phone calls, sometimes three or four a day. Then the same from ATD, (there dubious dept collecting wing). I sent a recorded letter requesting that the phone calls stop but they continue. I am now going to submit a bill for administration and also for damages. Because of the stress they have caused.
My advice- do not deal with this company, they are terrible in the extreme, stay well clear.

I did an upgrade of my mobile broadband contract over the phone with 3 mobile in November 2012, and part of the agreement was that they will send a free dongle to my home adress and waive the delivery charge of £1.99. The monthly fee was to be £15.99 and it was agreed that the new contract will take effect from December 2012.

Due to the conversation, I left just £15.99 in my direct debit account just to pay their monthly fee. I was miffed when I received my December bank statement, and it showed that 3 mobile had gone to my account to collect £17.98, ie. £15.99 + £1.99, which was to be waived, and due to insufficient money in the account, my bank refused to pay it. In deed my bank charged me £8 for failed direct debit.

I contacted 3 mobile before christmas to complain, and they confirmed that their records showed that the said delivery charge of £1.99, was actually waived, and promised to refund it. Again I left £15.99 in the said direct debit account hoping they will keep their promise. My shock knew no bounds when I got my January 2013 bill, and observed that 3 mobile tried again to collect £17.99 from my account and my bank refused to pay it due to insufficient funds. Again my bank charged me £8 for failed direct debit.

I complained to 3 mobile and requested that they waive the bill of £15.99 for December 2012 since, I have already lost £16 to my bank due to their failure keep our telephone agreement that delivery fee should be waived. But they said that they can only waive the £1.99, and that I must pay the bill of £15.99 for December in addition to losing £16.00 to my bank due to no fault of mine. They blamed me for not cancelling my direct debit mandate to them in order to avert the bank charges. I became really angry and I decided to cancel the direct debit on 4/1/13. On 5/1/13 someone from 3 mobile called me and I said that I can only remain on the contract if they will waive the December 2012 bill judging that it was their fault that my bank charged me a total of £16 for failed direct debits. The fellow said he will discuss with their manager and get back to me. On 7/1/13 he called back to say that they will not refund my December bill, and that I should pay it plus their charge for non-direct debit since I have now cancelled my direct debit. I told him there in and then that I am no longer their customer, that he should deactivate the dongle. I never used the new dongle anyway. I did not sign any written contract with them. It was made during a phone conversation, and it was 3 mobile that first reneged on the terms of the phone conversation as clearly shown above. Therefore I owe them nothing, as far as I am concerned the contract ended on 7/1/13.

For over a year from January 2011 to
November 2012 I paid 3 mobile £15.99 per month, and hardly used the old dongle since I was at college and had access to the internet and WIFI on my laptop. Yet they could not waive delivery charge of £1.99, which messed the new contract. Shame on them. I am now rid of them forever.

I had a 3 network dongle end it's 2 year contract in August 2012. I paid my final bill & thought everything was 'done & dusted'. Last week ADC began to call me asking for my details, which I refused to give them. When I asked who is ADC, I was told its Alpha Delta Company! I have been called everyday this week by them and they are awful people who lie to you. The problem is, I don't know how to shake them off me!!help!

Hi fellow victims, I was happy with Three, everything worked fine, phoned up to arrange to renew my contract for the third time, they set up a new contract, I challenged them to send a copy of the phone conversation where I agreed to it, in email they say no recording exists I got my bank to refund my money, they now have the debt collectors chasing me. As far as I am concerned, no recording of me agreeing to the contract means I did not agree a contract. I suggested they takes me to court, without the recording they have no evidence, so no case to answer.

I was pusuaded to change to Three from Vodaphone when I looked for the best deal that suited my internet and call usage. I would emphasise that I was happy enough with Vodaphone but my usage meant that I looked for the best deal. Unwittingly I thought that Three were a reputable telecoms company but I couldn't be more wrong.

My contract was for 700 minutes of air time including internet usage. However, I discovered to my cost that they did not include many of the numbers I regularly used. They implied that I had 700 minutes of talk and internet use but amazingly it covered very few of my calls. So insteas of paying £25 a month, I ended up with bills often 50 - 70% higher. Having trapped me in a contract they did little to resolve my complaints.

There were then problems in the way they handled my direct debit; somehow they were even fouling the payments up and still they did nothing to resolve my complaints.

Consequently when I paid a bill in October, I refused to pay anything of the line rental costs for November, my last month with them because they had not provided me with a service, having stopped calls from my phone.

Instead of customer service they passed my details onto Advanced Telecoms Debt Services Ltd. That company knew nothing of my dispute with Three and sent a letter threatening me with my details being shared with Credit Reference Agencies. Not unsurprisingly, the woman ELIN MCLEAN who signed the letter was not available to take my call (she does not know how to use a telephone - poor show as a manager.

Three would do better if they stopped defrauding customers with excessive charges and made certain that ones monthly payment covered calls - there being no get out clauses.

Never, ever use Three as your Mobile provider - poor service, low quality and bad practices mean that I will never have anything to do with them.

As per other users, i have experienced exactly the same when trying to close my account, i was held on the line for over forty minutes before speaking to 3, that cost me over £8....!!!!! and they will not reimburse it. i then received the same threatening letter from Advanced Telecom(who are actually 3) and when i spoke to them they were very threatening and said they would take further action, so i said fine see you in court as they are not a registered debt collection agency, he wouldn't even put a hold on the action til the next day..i am taking legal advice and also complaining to of com....3 are a bunch of pirates do not get involved with them.

The debt collection agency claim they have no e-mail address. I will never use 3 again. They charged for 2 contracts when I only had one, took DD from my account and do not call me despite my best efforts to resolve.

I too have been scammed with this 3 network, i recently had some items stolen from my property, which included my mobile phone, so i went to 3 to cancel, as i was sooo angry, but with regards to that the amount of charges they want me to pay for something that was not my fault was awful, besides that i still have an on-going feud with them, as when i took the contract on i was told 25.00 a month, no more no less and to put a stop on this so that i could not go over the amount, hahaha bet they had a right laugh at my expense, to say the least i was having phone bills of nearly up to 50.00 per month, and i kept reporting this, and they did nothing!!!!
I would not rate 3 again, i have now had to go back to my reliable nokia brick phone with a tesco sim card, at which for a tenner i get twenty quid free, a total of thirty quid, which is brill, and that includes free texts and cheap calls!!!

Three have been pursuing me using 3 different debt collection agencies
it's a complete con
sent them 2 faulty phones back for repair
they promised to send a courier to collect them as i'm registered disabled
they also sent me what they called a temporary phone which turned out to be a 2 year upgrade which off course is unsolicited & illegal
im being harrased at present but have complained to the ombudsman recently .
Ombudsman has acknowledged my email .
Now I've decided to not negotiate with the debt collection agencies at all . wait to see what the ombudsman says first .
2 handsets & a broadband dongle was sent to them near the end of an 18 month contract.
I'm a strong person mentally, emotionally & spiritually so im not to worried about all this but still it's not right.
Time now to change my home telephone number
Have also taken legal advice about this matter.
Three & the debt collection agencies will get no more money from me & all letters will go straight to my shredder. I'll also get my MP involved in this too.
Governments accross the world have put us all at the mercy of companies who only want to bleed us dry. That's the reason the rich are rich!!

Just been going through the same scenario (similar to the ones above). The most recent is a customer service rep in India in a conference call with a chap in the UK and they could not resolve the issue!

THREE should be avoided at all costs. DO NOT sign up with them however enticing the deals! However enticing!!!!

At last I have managed to log into your site thanks for fixing it.

I am still awaiting a proper reply from 3 and still awaiting a returns pack after more than 2 weeks of them saying it has been sent out.

I have a bad feeling that this is going to lead to the same sort of issues of the OP's message of legal action towards myself even though Three are at fault so I have also started my own blog at http://connedbythree.blogspot.com/

I really hope that together we can get something done about Three as they have ruined my life and its not fair on my kids.

I will keep track of this blog aswell as my own and hope to help others the best I can and ask if anyone can help us then please get in touch as these issues need to be resolved asap.

Thanks for reading and I hope that you all have a super summer kind regards,

I have been with Three for 6 years and have had lots of lies and stress which has affected my mental health.

They lie and cheat there customers and I am thinking of setting up an online campaign and petition to get as many people as I can to share there experiences and get something done about them.

They will not let you leave and I have had so many problems today I have had enough and canceled there payments as they just do not listen.

My most recent experience was again trying to leave as I get no signal at my new address and also being over my 18 month contract.I had a 3 hour discussion with them and they sweet talked there way into sending my a Nokia N97 for £100 which I could not afford to pay.
A few days after I received the handset which was worse than my broken refurbished N95 that they sent me which was sent back to them over 6 times and in the end they still did not fix it but that's another matter. They decided to charge me £176 for this Nokia N97 and will not listen to my emails at all even though I asked to get this matter sorted via email they still phone me to resolve this issue but are no help.

I would like to share my story in full but cannot seem to log into this website so look forward to your reply's and hope that we can get something done about them and get compensated for all hassle.
